These terms apply to your use of the Exoctica International Corporation website and, together with your signed order form, to your use of our platform and services.
Scope
Where your order form or a signed agreement says something different from these terms, the signed document applies.
Accounts
You are responsible for the people you give access to, for keeping sign-in details secure, and for telling us promptly if you suspect unauthorised access.
Fees and payment
- Setup fees are quoted once, in writing, before work starts.
- Subscriptions are billed monthly or annually in US dollars, in advance.
- Prices exclude taxes, which are added where they apply.
- Custom systems and trip apps are priced per project as set out in the quote.
Your data
You own the data you put into the platform. We process it only to provide the service, under our Privacy Policy and any data processing agreement between us. You can export it at any time.
Intellectual property
We own the platform and its underlying software. Apps we build and publish under your developer accounts carry your brand, and the ownership of custom work is set out in the project quote.
Availability
We aim for 99.9% uptime and schedule maintenance outside business hours where we can. Enterprise plans include a written service level agreement.
Liability
To the extent the law allows, our total liability in any 12-month period is limited to the fees you paid us in that period, and neither party is liable for indirect or consequential loss.
Ending the agreement
Either party can end a subscription at the end of the current billing period with written notice. After it ends we will make your data available for export for 30 days, then delete it.
